1. Agreement to Terms
These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and Pseudobrook ("Company," "we," "us," or "our"), governing your access to and use of the pseudobrook.org website located at pseudobrook.org (the "Site") and the software-as-a-service (SaaS) platform and related services offered through the Site (collectively, the "Service"). By accessing, registering for, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
If you are entering into this Agreement on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and in such cases, "you" and "User" will refer to that entity. If you do not have such authority or do not agree with all of the Terms, you must not access or use the Service.
We may revise these Terms from time to time in our sole discretion. The most current version will always be posted on this page with the "Last Updated" date reflected above. Your continued use of the Service following the posting of any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
These Terms incorporate by reference our Privacy Policy and Cookie Policy, which describe how we collect, use, and protect your personal information in accordance with applicable laws, including the CCPA/CPRA and other applicable state privacy laws. Please review these policies carefully.
2. Service Description
Pseudobrook provides a cloud-based software-as-a-service (SaaS) platform that enables users to access, manage, and utilize our software applications and related tools through a web browser or authorized application programming interface (API). The Service includes features such as data storage, analytics, collaboration tools, integrations with third-party services, and other functionalities as described in our documentation and marketing materials.
The Service is provided on a subscription basis, with various tiers and feature sets available depending on your selected plan. We reserve the right to modify, add, or remove features and functionalities at any time without prior notice, except as expressly provided in these Terms. Any new features or tools added to the Service will be subject to these Terms unless otherwise stated.
We do not guarantee that the Service will meet your specific requirements, operate uninterrupted, or be error-free. The Service is provided for general business and professional use, and you are solely responsible for ensuring that the Service meets your needs and complies with any industry-specific regulations or standards applicable to your business.
The Service is not intended for use by individuals under the age of 18. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this Agreement.
3. User Accounts
To access certain features of the Service, you must register for an account by providing accurate, current, and complete information as requested in the registration form. You are responsible for maintaining the accuracy of your account information and updating it as necessary. Failure to provide accurate information may result in the suspension or termination of your account.
You are solely responsible for maintaining the confidentiality and security of your account credentials, including your username, password, and any API keys or access tokens. You agree to notify us immediately of any unauthorized use of your account or any other security breach. We will not be liable for any loss or damage arising from your failure to comply with these security obligations.
Each user may maintain only one account unless otherwise authorized by us in writing. You may not share your account credentials with other individuals or allow multiple users to access the Service through a single account unless your subscription plan explicitly permits multiple users or seats. You are responsible for all activities that occur under your account, whether authorized or unauthorized.
We reserve the right to suspend or terminate your account if we suspect any fraudulent, abusive, or unlawful activity. We may also require additional verification information at any time to confirm your identity or the legitimacy of your account. 4. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Service. You must comply with all applicable laws, regulations, and third-party agreements when using the Service.
You are responsible for all content and data you upload, transmit, or store using the Service ("User Content"). You must ensure that your User Content does not violate any intellectual property rights, privacy rights, or other rights of any third party. You must obtain all necessary consents and permissions before uploading or sharing User Content that belongs to or contains personal information of others.
You agree not to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service or any underlying software. You may not use the Service to develop a competing product or service, or to extract data from the Service for commercial purposes without our express written consent. Automated access to the Service is permitted only through our authorized API and in compliance with our API usage guidelines.
You must not use the Service to send unsolicited communications, including spam, or to distribute malware, viruses, or other malicious code. You must not attempt to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to the Service. Any violation of this Acceptable Use Policy may result in immediate suspension or termination of your account and may subject you to legal liability.
5. Prohibited Activities
The following activities are strictly prohibited while using the Service. This list is not exhaustive, and we reserve the right to determine what conduct is inappropriate:
- Using the Service for any illegal purpose, including but not limited to fraud, money laundering, terrorism, or violation of export control laws;
- Infringing upon the intellectual property rights, privacy rights, or other proprietary rights of any third party;
- Uploading, transmitting, or storing content that is defamatory, obscene, pornographic, harassing, or otherwise objectionable;
- Distributing malware, viruses, trojans, worms, or any other malicious or harmful code;
- Attempting to circumvent or breach any security features of the Service;
- Scraping, crawling, or otherwise extracting data from the Service without authorization;
- Using the Service to send unsolicited commercial communications or spam;
- Interfering with or disrupting the Service, servers, or networks connected to the Service;
- Creating a false identity or impersonating another person or entity;
- Using the Service in violation of any applicable laws, including the CAN-SPAM Act, the Computer Fraud and Abuse Act, or similar state and federal legislation.
Violations of these prohibitions may result in immediate account suspension, termination of your subscription without refund, and potential legal action. We reserve the right to report any illegal activities to the appropriate law enforcement authorities.
We may implement technical measures to detect and prevent prohibited activities, including automated content scanning, rate limiting, and behavioral analysis. You consent to these measures as a condition of using the Service.
6. Content Ownership
The Service, including its software, design, text, graphics, logos, and all other elements, is owned by Pseudobrook and is protected by United States and international intellectual property laws. We retain all right, title, and interest in and to the Service, including all modifications, enhancements, and derivative works thereof. No rights are granted to you except as expressly set forth in these Terms.
You retain all ownership rights in and to your User Content. By uploading or submitting User Content to the Service, you grant Pseudobrook a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, use, display, reproduce, modify, adapt, publish, translate, create derivative works from, and distribute your User Content solely for the purpose of operating, providing, and improving the Service.
You represent and warrant that you own or have the necessary rights to all User Content you submit to the Service, and that your User Content does not violate any law or third-party rights. You are solely responsible for your User Content and any consequences of submitting it to the Service. We are not liable for any User Content, and we do not endorse or guarantee the accuracy, completeness, or safety of any User Content.
We may remove or disable access to any User Content that we believe, in our sole discretion, violates these Terms or applicable law. We have no obligation to monitor User Content but reserve the right to do so. If you believe any User Content infringes your intellectual property rights, please submit a notice to [email protected] in accordance with the Digital Millennium Copyright Act (DMCA).
7. User-Generated Content
If the Service includes features that allow users to share, publish, or display User Content to other users (such as forums, comments, or collaborative workspaces), you are solely responsible for the User Content you choose to share. You must ensure that your shared User Content complies with these Terms and does not contain any confidential, proprietary, or sensitive information that you do not wish to make public.
By sharing User Content through the Service, you grant other users a limited license to view, access, and use your User Content solely within the context of the Service. You may revoke this license by removing your User Content from the shared features, though we cannot guarantee that other users have not already copied or stored your User Content.
We do not pre-screen User Content but reserve the right to remove, hide, or restrict access to any User Content that we determine, in our sole discretion, is objectionable, inaccurate, or violates these Terms. We may also terminate or suspend accounts of users who repeatedly post inappropriate or violating User Content.
You acknowledge that User Content may be subject to applicable privacy laws, including the CCPA/CPRA. You must not share personal information of others without their consent. For more information about how we handle personal information, please review our Privacy Policy.
8. Payment Terms
Subscription fees for the Service are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). All fees are payable in U.S. dollars unless otherwise stated. By subscribing to a paid plan
